Terms of Use
Last updated 31 October 2026
These terms are an agreement between you and FocusUp for using the FocusUp app and this website. By creating an account or using the app, you agree to them.
FocusUp is provided by Kfir Aviya Avikassis (“FocusUp”, “we”, “us”). You can reach us at support@focusup.app.
You must be at least 13 years old to use FocusUp.
You need an account so your practice can be backed up. Use an email address you can reach, keep your password to yourself, and tell us if you think someone else has used your account. You’re responsible for what happens under your account.
You can delete your account at any time in the app’s Settings. Our Privacy Policy explains what we collect and how we handle it.
FocusUp offers short challenges at the moment you reach for apps you choose (“the Gate”) and one short practice a day. It’s a tool for building a habit.
FocusUp is free to download. When you create your account, you get 7 days of full access with no payment details needed. Nothing is charged when the free week ends. To keep starting new practices and gates after it, you need a subscription. Whatever you’ve already built, such as your orb, your history and your journal, stays visible either way.
Prices are in US dollars. Apple sets the price in your country and currency and shows it, including any taxes, before you confirm a purchase.
Some yearly offers include an Apple free trial, for example 2 weeks or 3 days. The offer screen and Apple’s purchase sheet always show how long the trial lasts and what you’ll pay afterwards. When the trial ends, the yearly subscription starts and you’re charged, unless you cancel at least 24 hours before the trial ends. Apple allows one free trial per subscription per Apple ID. If you buy a subscription during a free trial, any unused part of the trial ends.
Apple handles all payments, so refunds are decided by Apple under its policies. You can ask for one at reportaproblem.apple.com. If we change a price, existing subscribers are told in advance, as Apple requires, and where the law or Apple requires it, the new price only applies once you agree.
What you write in FocusUp, such as journal entries, reflections and feedback, stays yours. You allow us to store, back up and process it only so we can run FocusUp for you. We don’t publish it or show it to anyone else.
Please don’t misuse FocusUp. That means not trying to break into accounts or systems, not reverse-engineering or copying the app except where the law allows it, not interfering with the service or overloading it, not getting around subscriptions or free-trial limits, and not using FocusUp to break the law.
FocusUp, including its design, the orb, its challenges, text and code, belongs to us or our licensors. We give you a personal, non-transferable licence to use the app on Apple devices you own or control, under these terms and Apple’s. App names and logos shown in FocusUp belong to their owners and are used only to identify those apps.
You get FocusUp through Apple’s App Store, so Apple’s Licensed Application End User License Agreement (the standard EULA) also applies. If it conflicts with these terms, these terms apply as far as the EULA allows.
These terms are between you and us, not Apple. Apple isn’t responsible for FocusUp, its content, maintenance or support, or for any claims about it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
FocusUp is provided “as is” and “as available”. As far as the law allows, we make no warranties beyond those stated in these terms, and we don’t promise that the app will always be available, error-free, or that your data can never be lost. Keep anything irreplaceable somewhere else too.
As far as the law allows, we aren’t liable for indirect or consequential losses, and our total liability for any claim about FocusUp is limited to the amount you paid us for it in the 12 months before the claim. Nothing in these terms limits liability that can’t legally be limited, or takes away rights you have as a consumer under the law where you live.
You can stop using FocusUp and delete your account whenever you like. Remember to cancel your subscription with Apple too. We may suspend or close an account that seriously or repeatedly breaks these terms, and we’ll tell you why unless the law prevents it. If we ever shut FocusUp down, we’ll give you reasonable notice.
We may update these terms as FocusUp changes. We’ll update the date at the top, and for meaningful changes we’ll tell you in the app before they take effect. If you keep using FocusUp after that, the new terms apply. If you don’t agree, you can stop using it and cancel your subscription.
These terms are governed by the laws of the country where FocusUp’s developer is based, and disputes go to the courts there, unless the consumer laws where you live give you the right to bring a claim locally.
